Following
are the terms and conditions related to payment and delivery of
vehicles.
1. Stock list
&
Prices
We voluntarily limit our
stock to a few dozen units at a time and favour originality and
quality,
over price or quantity.
Pictures & comments
provided are from actual units for sale; if additional shots or details
are required, we are glad
to comply, please inquire.
Price discounts are acceptable within reasonable limits; feel free to
send
your offer.
However, please keep in
mind, when accepted we will expect you to commit immediately.
Prices may vary without
prior notice (usually down but sometimes up).
No car can be removed from
our stock list or reserved for a particular customer, unless it has
been
paid for.
2. Sale
Agreement/Pro-forma
Invoice
Once we have agreed on a
particular vehicle and on a price, we produce and forward by email (or
fax when required)
a Sales Agreement with
vehicle
description, shipping schedule, bank details and other relevant
information.
The Agreement once
printed,
signed and faxed back to us constitutes the initial step of our
business
relationship and
the legal basis for the
transaction. Whenever possible, we will gladly modify its terms to suit
customer requirements.
Our cars are guaranteed
exactly to conform to the agreement description.
3. Full Payment
&
Deposits
FULL payment of US$ C.I.F.
or C&F is required upon confirmation before a stock purchase can be
shipped to your
destination. All C.I.F.
payments are final and irrevocable. Except in the case of a long
standing
business relationship;
we do not support the
practice
of delayed payment and/or fractioned payments. A fax copy of the fund
remittance
document from your bank
is usually considered acceptable proof of payment and will suffice to
initiate
vessel booking
and custom clearance of
shipment.
PARTIAL payment (at least
50%) is required to initiate auction purchase orders. In most cases,
the
purchase will only
be finalized after
approval
from the customer and if a purchase request could not be completed
within
the agreed timeframe,
customer is entitled to
FULL REFUND (see next item).
Prices are subject to
change
due to fluctuation in foreign exchange rate between the U.S. Dollar and
the Japanese yen
without advance notice.
We provide a choice of
three
different company accounts for overseas wire transfers, one in US$, JA$
and also another
in ¥ (Japanese Yen).
Cash payment is acceptable for visiting customers, tourists or
residents
of Jamaica or Japan.
Credit cards, cheques and
Letter of Credits are NOT acceptable forms of payment.
4. Refund
Policy
Our cars are guaranteed
true & conform to their description as outlined in our Sales
Agreement
and our grading policy.
Therefore, a refund is
possible
in the very improbable case of a customer receiving a car not exactly
conforming
to the
Sales Agreement
description.
Refunds are also considered in the following three (3) cases:
1) Payment was done for
a stock unit that unexpectedly became unavailable, we return the funds
entirely & immediately
OR we provide a similar
unit, AT YOUR PREFERENCE.
2) After a reasonable
period
of time (usually 31 days from deposit reception, or otherwise agreed
upon
at time of order)
we fail to complete an
auction
and/or dealer purchase request, the customer is entitled to entire
&
immediate refund of deposit.
3) A customer who
wishes
to cancel an auction purchase order prematurely or after apparently
suitable
units were refused
without sufficient reason,
we refund the deposit, MINUS a cancellation fee of US$500.00 (Five
Hundred
only)
AUCTION PURCHASES
EXECUTED
ACCORDING TO CUSTOMER REQUIREMENTS AND STOCK PURCHASES LISTED
ON OUR WEBSITE ARE
CONSIDERED
FINAL SALES.
5. Domestic &
International
Shipping
All domestic shipping and
processing charges are included in listed FOB prices.
FOB price includes the
following:
Vehicles real cost &
mark up, return of plates & de-registration, documentation &
translation
of documents, domestic transfers
from yard to port, custom
clearance inspection & fees, port movements from bonded area until
boarding of "roll on/roll off"
carrier vessel. Besides,
ocean freight is usually calculated separately as there is no hidden
cost
to be added to the FOB price.
International freight
charges
vary with volume & weight of unit, port of destination and US$
exchange
rates. We use professional
and reputable shipping
companies
affiliated with the largest auto-makers (example: Toyota, Nissan, etc.)
The vessels being used
are for brand new car
shipments,
which are also used for our vehicles and have so far proven entirely
satisfactory.
Basic Marine Insurance
is
already calculated in the ocean charge. Marine Insurance coverage is
limited
to the risk of total loss,
disasters, Acts of God,
etc. These are damages that are clearly imputable to negligence of the
carrier. Basic Marine Insurance,
however, does not cover
such risk as petty theft (such an occurrence is easily avoided by
shipping
separately loose/small
accessories and parts).
Therefore, to ensure the safety of your cargo, optional marine
insurance
is recommended.
This is usually offered
at an additional cost of 1.0% of the C&F.
We would like to take
this
opportunity to notify our potential purchasers of the malpractice that
takes place during clearance of
the vehicle at the port
of entry. Missing items such as radio, cassette player, CD, power
window
switch, cigarette lighter, TV,
ashtray, door mirror, rear
mirror, things like monograms and various other parts of the vehicle
will
not be the responsibility of
Dolphin Motors and/or our
agents.
We will not be held
responsible
for any changes in the name of the vessel, shipping dates, payment
claim(s),
etc caused by
the Shipping Company. Nor
will we be held responsible for any delays caused by the Customs
Department
in the importing
country (i.e. final
destination
of arrival).
6. Vehicle &
Shipping
Documents
Upon confirmation of
payment
for the vehicle & all freight charges; we will initiate shipment of
the agreed unit.
Within four (4) ~ five (5)
working days after the departure of the vessel we receive the original
Bill of Lading; which
is immediately forwarded
to the customer/consignee.
Therefore, all
necessary
documents should be in the customer’s hands usually within 5 but not
exceeding
10 working days
after vessels actual
departing
date.Typical documentation/items provided include the following:
1) FOB/CIF receipt of
sale
(commercial invoice describing unit & price) for tax purposes.
2) Original Vehicle
De-registration
Document ("Masho" with separate certified English translation).
3) Original copy of
Bill
of Lading, necessary to collect vehicle at destination.
4) In addition, owner
manuals,
service books, auction report, loose delicate items (remote units, anti
theft stereo fascias) are
forwarded separately
if/when
available.

and practical information to facilitate processing of your private

can usually be provided upon
request on a case by case
basis; however, our service usually ends with the delivery of described
goods at point of entry in customer's country.
7. Quality
Standards
Unless mentioned
otherwise,
all vehicles for sale are well above average condition, mechanically
and
physically sound, complete
and reasonably clean prior
to shipment. An average condition (grade 3.0 and above) is often a
modest
statement with respect to
‘used car’ condition in
other countries. Quality evaluation of auction vehicles is typically
done
in three steps.
1) By the seller
himself
who must provide an extensive & fair condition report. Untrue or
incomplete
information may result in
license removal, exclusion
from membership and legal procedures.
2) By highly trained and
unbiased auction staff. The auction house perceives a fixed commission
(not a %) regardless of selling
price and has therefore
no gain in beautifying reality.
3) By ourselves before
(and
to some extent after) purchase. All components are evaluated in a
stationary
position.
However vehicles will run
a short distance through the auction tunnel.
NOTE: Extended drive
tests
are not possible before or after purchase and items such as clutch,
filters,
belts & brake pads,
fuel consumption or
emission
levels, are inspected but cannot be thoroughly tested and therefore
cannot
be guaranteed.
Vehicles are shipped
true
to the "Sales Agreement" and/or auction report. No claim other than
different
shipment description,
damage due to negligence
or loss of shipment can be taken into consideration unless otherwise
agreed
at time of order.
8. Auction
Request
& Preview
Osaka, Nagoya Tokyo and
Toyama auctions offer attractive prices, casual atmosphere and the
largest
choice of Sport, Performance
4WD & Turbo Diesel
units
in Japan. Up to 5000 units is offered for sale weekly in these areas.
Auction sales large or
small
happen almost every day of the week, all year long. However, the main
ones
are on Wednesday & Thursday.
We generally preview cars
at least one day prior to actual sale and will be glad to escort our
visiting
customers to auction previews.
In the case of
customers
with purchase agreements & standing deposits, pictures and details
of potentially suitable units are forwarded
the day before actual sale
and approval is usually requested before we proceed with actual
purchase.
9. Warranty
As Vehicle Export &
Import Consultants we undertake at all times to represent vehicles as
accurately
as possible, we are however
reliant upon third parties
for such information, therefore we do not accept responsibility for the
condition either mechanically,
structurally or otherwise
of any vehicle sourced through us. All vehicles are delivered on the
basis
of "all care but no responsibility".
10. Indemnity
Purchaser agrees fully to
indemnify, defend and hold us, and our officers, directors, employees,
agents and suppliers, harmless
from and against all
claims,
liability, damages, losses, costs and expenses, including legal fees,
arising
out of any breach of the
Conditions by you or any
other liabilities arising out of importation of the motor vehicle(s).
